Build Enquiry is a real estate CRM and lead management platform designed to help real estate businesses, builders, developers, brokers, agents, and sales teams manage their business activities.
Depending on the features available under your plan, the Services may include:

Customer and contact management
Follow-up and task management
Site visit management
Property, project, and inventory management
Booking management
KYC and document management
Payment and receipt tracking
Sales and performance reports
User and role management
Third-party integrations
WhatsApp, email, and other communication-related integrations
We may add, modify, suspend, or discontinue features from time to time.
You must provide accurate, complete, and current information when creating or maintaining an account.
You are responsible for:
Maintaining the confidentiality of your login credentials
Restricting unauthorized access to your account
All activities performed through your account
Ensuring that information provided by you is accurate and lawful
You must notify us promptly if you believe that your account or login credentials have been accessed or used without authorization.
We reserve the right to suspend or terminate accounts that contain false information, are used fraudulently, or violate these Terms.
Certain Build Enquiry features may require a paid subscription or a separately agreed commercial arrangement.
Your access to the Services may depend on:

You have obtained all necessary notices, permissions, and consents required by applicable law.
Your use of Customer Data complies with applicable privacy, data protection, marketing, and other laws.
Customer Data does not infringe the rights of any third party.
Customer Data does not contain unlawful, fraudulent, malicious, or prohibited content.
Build Enquiry does not independently verify the accuracy, legality, ownership, or completeness of Customer Data.
As between you and Build Enquiry, you retain your rights in the Customer Data that you submit to the platform.
You grant us the limited right to host, store, process, transmit, back up, and otherwise use Customer Data solely as reasonably necessary to provide, maintain, secure, improve, and support the Services.
We may use aggregated, anonymized, or de-identified information that does not reasonably identify you or an individual for analytics, security, product improvement, and business purposes, subject to applicable law.
You agree not to use the Services to:

Build Enquiry is not responsible for messages, content, or communications created or sent by you or your authorized users.
You may be able to create or manage accounts for your employees, agents, sales representatives, or other authorized users.
You are responsible for:
Managing access permissions appropriately
Adding only authorized users
Removing access when a user no longer requires it
Monitoring activities performed by users under your account
Ensuring that your users comply with these Terms
You are responsible for activities performed by authorized users associated with your account.
The Build Enquiry platform, including its software, design, branding, content, features, interfaces, documentation, trademarks, and other intellectual property, is owned by or licensed to Broadsy Technologies Pvt. Ltd. and is protected by applicable intellectual property laws.
Subject to your compliance with these Terms and applicable payment obligations, we grant you a limited, non-exclusive, non-transferable, non-sublicensable right to access and use the Services for your internal business purposes during the applicable subscription period.
These Terms do not transfer ownership of any Build Enquiry intellectual property to you.
If we provide custom development, implementation, integrations, modifications, or other professional services, the scope, timeline, fees, deliverables, and ownership terms may be governed by a separate proposal, quotation, statement of work, or written agreement.
Where a separate written agreement applies, its terms will govern the applicable services to the extent of any conflict with these Terms.
We aim to provide reliable and secure Services. However, we do not guarantee that the Services will always be available, uninterrupted, error-free, or free from all security risks.
The Services may be temporarily unavailable due to:
Scheduled maintenance
Emergency maintenance
Software updates
Infrastructure failures
Internet or network issues
Third-party service failures
Events beyond our reasonable control
We may perform maintenance and updates as reasonably necessary to operate and improve the Services.
While we may implement reasonable data backup and recovery practices, you are encouraged to maintain appropriate backups of important business information and documents where necessary.
You are responsible for maintaining copies of information where required for your legal, business, accounting, or operational purposes.
We may suspend or terminate your access to the Services if:

You are encouraged to request or export your data before the end of your access period where applicable.
The Services are provided on an "as is" and "as available" basis, except to the extent otherwise expressly agreed in writing.
To the maximum extent permitted by applicable law, we do not guarantee that:
The Services will meet every specific business requirement
The Services will be uninterrupted or error-free
All data will always be available without interruption
Results obtained from the Services will be accurate or suitable for every purpose
Third-party integrations will remain continuously available
You are responsible for determining whether the Services are suitable for your particular business requirements.
To the maximum extent permitted by applicable law, Build Enquiry and Broadsy Technologies Pvt. Ltd. will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, business opportunities, goodwill, or data arising from or related to your use of the Services.
Where liability cannot legally be excluded, our liability will be limited to the maximum extent permitted by applicable law.
Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.
You agree to defend, indemnify, and hold harmless Build Enquiry, Broadsy Technologies Pvt. Ltd., and their respective directors, employees, and representatives from claims, damages, liabilities, costs, and expenses arising from:
Your use of the Services in violation of these Terms
Your Customer Data
Your violation of applicable law
Your infringement of third-party rights
Unauthorized or unlawful communications sent through your account
We may modify the Services and these Terms from time to time.
When we update these Terms, we will revise the "Last Updated" date. Where required by applicable law, we will provide additional notice of material changes.
Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
These Terms shall be governed by and interpreted in accordance with the laws of Ahmedabad, Gujarat, India, unless otherwise required by applicable law or agreed in a separate written agreement.
Subject to applicable law, the courts having jurisdiction over the registered office of Broadsy Technologies Pvt. Ltd. shall have jurisdiction over disputes arising from these Terms or the Services.
